Terms of Service
These Terms of Service (“Terms”) are a binding agreement between you and Dan Kapellusch, doing business as Mise en Place (“Mise en Place,” “we,” “us”). By creating an account or using the Mise en Place application, website, or related services (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Mise en Place is a household cooking application: it lets you save and organize recipes, plan meals, generate shopping lists, and cook with guided instructions. Some features use artificial intelligence to import, structure, search, or generate recipe content (“AI Features”).
We may add, change, or remove features at any time. The Service is offered as-is on the tier you are subscribed to, including a free tier whose features and quotas may change.
2. Accounts and households
- You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.
- You are responsible for your account credentials and for all activity under your account.
- Households let multiple accounts share meal plans, shopping lists, and recipes. Content you add to a household is visible to its members. If you leave a household, content you contributed to shared household resources may remain with that household.
- Household member profiles you create for people without accounts (e.g., children) are your responsibility; you confirm you are entitled to provide any personal details you enter about them.
3. Your content
“Your Content” means anything you add to the Service: recipes you write, notes, photos you upload, meal plans, chat messages to the assistant, and content you import.
- You own Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and display Your Content solely as needed to operate, provide, and improve the Service (including generating images, structuring recipes, and enabling household sharing).
- Community sharing. If you choose to share a recipe to the community, you additionally grant us and other users the right to view and save that recipe within the Service. Don't share content you don't have the right to share — in particular, photographs or substantial creative text authored by someone else.
- You can delete Your Content at any time; deletion removes it from active systems within a commercially reasonable period, subject to backups and content already saved by other users through community sharing you initiated.
4. Recipes, imports, and copyright
- Recipes as facts. Lists of ingredients and bare cooking procedures are generally not protected by copyright. Creative expression — photographs, headnotes, personal stories, and substantially original descriptive text — can be.
- Import is a personal clipping tool. The import feature retrieves a page, extracts the recipe's functional content (ingredients, steps, quantities, times), and saves it to your private recipe box, at your direction, for your personal household use — like a digital recipe card. Imports are private by default.
- Source attribution. Where a recipe is imported from a URL, we retain and display the source link. You agree not to remove attribution in order to pass off another creator's work as your own.
- Your responsibility on sharing. Do not share imported creative content (e.g., the original author's photos or personal prose) to the community. We may remove community content that appears to infringe and may suspend accounts that repeatedly do so.
5. Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to dkapellusch@gmail.com including: (a) identification of the work, (b) the URL or location of the allegedly infringing material, (c) your contact information, (d) a statement of good-faith belief that the use is unauthorized, (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the owner, and (f) your physical or electronic signature. We will respond consistent with the Digital Millennium Copyright Act, including removing material where appropriate and terminating repeat infringers. Counter-notices may be sent to the same address.
6. AI features — important disclaimers
- AI Features can produce content that is inaccurate, incomplete, or unsafe. Recipes, ingredient substitutions, cooking times, temperatures, and nutritional or dietary information generated or transformed by AI are suggestions, not professional advice.
- Food safety is your responsibility. Always use your own judgment on cooking temperatures, doneness, storage, and hygiene. Verify against authoritative guidance where health is at stake.
- Allergies and dietary restrictions. Dietary tags, filters, and assistant suggestions are convenience features and can be wrong or incomplete. Never rely on the Service to protect you or others from allergens or to comply with medical dietary requirements. Always read actual ingredient labels and confirm with the people you cook for.
- AI-generated images are illustrative and may not depict the actual dish.
- You are responsible for reviewing AI-drafted recipes before saving, sharing, or cooking them.
7. Acceptable use
You agree not to:
- use the Service in violation of law or these Terms;
- upload content that is unlawful, infringing, hateful, or harmful;
- probe, scan, or test the vulnerability of the Service, or bypass authentication or rate limits;
- scrape, harvest, or bulk-export content or data from the Service, or use the Service to build a competing dataset;
- abuse AI Features (including attempts to generate prohibited content or to exhaust shared quotas);
- resell or provide the Service to third parties except through features we provide (like households).
We may throttle, suspend, or terminate accounts that violate this section.
8. Subscriptions and paid tiers
The Service currently offers account tiers with different features and AI quotas. Today all tiers are granted without charge; free-tier features and quotas may change. If we introduce paid subscriptions, prices and terms will be presented at purchase and, unless stated otherwise: subscriptions will renew automatically until cancelled, you may cancel any time effective at the end of the billing period, and fees will be non-refundable except where required by law.
9. Third-party services and content
The Service links to and imports from third-party websites and uses third-party providers (hosting, authentication, AI models). We do not control third-party sites and are not responsible for their content, availability, or terms. Recipes on the community feed are user-provided; we do not endorse or verify them.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (with reasonable notice where practicable). Sections 3 (license, as needed to wind down), 6, 11, 12, 13, and 14 survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT RECIPES, NUTRITIONAL INFORMATION, DIETARY TAGS, OR AI OUTPUTS ARE ACCURATE, COMPLETE, OR SAFE FOR YOUR CIRCUMSTANCES.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL; (b) WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM FOOD PREPARATION, CONSUMPTION, ALLERGIC REACTIONS, OR DIETARY DECISIONS MADE IN RELIANCE ON THE SERVICE; AND (c) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (ii) USD $50.
Some jurisdictions do not allow certain limitations; in those places, these limits apply to the fullest extent permitted.
13. Indemnification
You will defend and indemnify us against claims arising from Your Content, your misuse of the Service, or your violation of these Terms or of another party's rights — including copyright claims arising from content you shared to the community.
14. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, excluding its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms. For material changes we will give reasonable notice (e.g., in-app or by email). Continued use after the effective date constitutes acceptance. The “Last updated” date reflects the latest revision.
